Breaking News: PFML Private Plan Reporting in Massachusetts

On February 14, 2024, the Massachusetts Department of Family and Medical Leave (DFML) announced reporting requirements for paid family and medical leave private plans. Employers, insurance carriers, and third-party administrators may have received a blast email directly from DFML with the announcement. So, what does this mean for private plans?

According to the PFML law at M.G.L. c. 175M, sec. 11, private plans have been required to maintain reports, information and records related to their approved plan and provide data to the DFML if requested. Well, that request has come.

For employers with fully-insured PFML private plans, carriers will upload an aggregated report no later than August 31, 2024, which includes the data found here https://www.mass.gov/doc/dfml-private-plan-employer-reporting-template/download for the fiscal year July 1, 2023 to June 30, 2024.

For employers with a self-funded PFML private plan, no later than August 31, 2024, the employer will upload separate reports for each FEIN with a private plan. The report will include the same data found here https://www.mass.gov/doc/dfml-private-plan-employer-reporting-template/download for the fiscal year July 1, 2023 to June 30, 2024.

The reporting information will generally include approved claims data, with leave types and duration; denied claims data, including reasons for denial, and average benefit amounts paid. DFML will open the submission form on July 1, 2024, and all information can be found here Employer Private Plan Reporting Obligations | Mass.gov.
